TERMS ANS CONDITIONS for CONFERENCE DELEGATE PARTICIPATION

1/ ORGANISER

The conferences on the 20th and 21st of March 2013 within the context of Biogaz Europe and the Salon Bois Energie 2013 (hereinafter the « Conference ») are organised by Bioénergie Evénements et Services SAS or BEES (hereinafter the « Organiser »), 28 boulevard Gambetta, 39000 Lons le Saunier, France.

2/ REGISTERING

To register for the Conference, the registrant must follow the sequential steps indicated below :

- complete correclty and accurately and submit the online registration form to be found on the website www.biogaz-europe.com or www.boisenergie.com

- pay the total registration fee in accordance with payment terms set out herein.

Registering means that the individual (hereinafter the « Delegate ») applying to attend the Conference has read and understood these Terms and Conditions and any additional rules set by the Organiser and unreservedly agrees with them. Also, it means the Delegate accepts any new measure that might be imposed, for whatever reason, and that the Organiser makes known in the interest of the Conference.

Registering online constitutes a legally binding agreement. The Delegate may request an invoice and requests must be endorsed with either a purchase order number or by an authorised signatory.

3/ PAYMENT TERMS

A confirmation will be sent to the Delegate on receipt of the registration and payment of the total registration fee including all applicable taxes. If the delegate has requested an invoice, one will be sent by the Organisers. Payment must be received on registering via the online payment system. Registration is not complete nor confirmed and the Delegate does not have the right to attend nor to receive the benefits and services of the Conference, until correct payment has been received by the Organisers, according to the payment conditions. The Organisers cannot be held responsible for the non-arrival of registration information. If a Delegate has not heard within 7 days of registering, he or she is reqested to contact the Organisers.

4/ VAT

Present VAT rate is 19.60% and must be paid by the Delegate, whatever his or her nationality. Delegates from outside of France may apply directly for a VAT refund from the appropriate authorities or may use an intermediary company.

5/ CANCELLATION OR SUBSTITUTION

Cancellations and substitutions must be made in writing, by fax or by email.Cancellations made up to 6 weeks before the Conference will be charged at 50% of the invoice total. Cancellations made after this period will be charged the full invoice amount. Substitution is possible at any time up to the start date of the Conference, providing the Organisers have already received full payment and the name of the substituting Delegate is communicated to the Organisers in writing, by fax or by email. Non-attendance of the Conference does not constitute grounds for reimbursement.

6/ ADVERTISING - SURVEYS - POLLS

Delegates may not distribute advertising documents of any kind. Surveys and polls are strictly prohibited, unless otherwise authorized by the Organiser.

7/ RESPONSABILITY AND INSURANCE

The Delegate is responsible for any damage he/she causes to equipment or any third party or the Conference site. The Delegates is responsable at all times for his / her possessions and effects. In the case of theft, damage or loss of the Delegates possessions or effects, neither the Organiser nor the Conference site owners can be held liable in any way.

8/ LIABILITY AND GENERAL CONDITIONS

The Delegate agrees to attend Biogaz Europe and the Salon Bois Energie 2013 at his/her own risk. The Delegate agrees not to hold the Organisers personally liable or otherwise liable for any losses, damages, expenses, costs, claims or liabilities suffered or incurred by the Delegate, including consequential or indirect losses or loss of profit, through registering for the Conference, attending the Conference, cancellation of the Conference, failure of the Conference to achieve the Delegate's expectations, or any error or omission on the part of the Organisers.

The Organisers reserve the right to change the Terms and Conditions at any time without prior notice.

9/ THE PROGRAMME

The Organisers reserve the right to amend or cancel events on the published Conference programme. All events and speakers are correct at time of publication. The Organisers will do their best to ensure the programme goes ahead as scheduled. Any changes will be signalled on the conference website: www.biogaz-europe.com or www.boisenergie.com as soon as reasonably practicable.

10/ SPECIAL ARRANGEMENTS

It is the Delegate's responsibility to take the usual and necessay precautions in relation to any special dietary needs, and/or any food allergies and intolerances. The Organisers can not be held responsable or liable for any incidents arising from any such allergies or intolérances.

11/ CONFERENCE LANGUAGE

The conference languages are French and English - simultaneous translation is provided. The Delegate agrees to comply with all guidelines and instructions provided on site for the loan and use of the translation headsets. In the event of damage or loss to the headset loaned to the Delegate, the Delegate agrees to and accepts full liability and may be required to reimburse the organiser.

12/ SITE ACCESS

The Delegate agrees to follow all indications and signs provided on site during Biogaz Europe and the Salon Bois Energie 2013 and agrees not to enter any areas that are not speficied or designated to the Conference and to which access is therefore not authorised.

13/ DATES AND VENUE

The Organiser arranges the dates and location of the Conference. The Organiser reserves the right to amend for whatever reason the dates of Biogaz Europe or the Salon Bois Energie 2013, its duration, opening hours and its timing without obligation of compensation to the Delegate.

The Organiser accepts no liability for any resulting commercial loss sustained by Delegates, whatever the reason, particularly in case of delayed opening, early closure, destruction by, fire, accidents, or if using the premises was impossible following a public disaster, a natural disaster or any force majeure beyond the Organiser's control.

In this case, available sums of money from the Conference receipts, once all expenses have been paid, would be shared between the Conference Delegates, the Conference exhibitors and/or sponsors in proportion to the sums already paid, without recourse to appeal, whatever the reason, to the Organiser.

14/ PRIVACY

Introduction
The Organiser is committed to protecting the Delegate's privacy. This privacy statement explains data collection and use practices by the Organiser. By accessing the Conference website www.biogaz-europe.com or www.boisenergie.com, the Delegate consents to the information collection and use practices described below.

Collecting Personal Information
The Organiser will ask for information that personally identifies the Delegate or allows the Organiser to contact the Delegate. The personal information the Organiser collects may include the Delegate's name, contact details, e-mail address and a short profile of the Delegate's business activity.  

The Conference website may collect certain information about the Delegate's visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which the Delegate accesses the Internet; the date and time the Delegate accesses the Conference website; the pages that the Delegate accesses while on the Conference website and the Internet address of the website from which the Delegate linked directly to the Conference website. This information is used for the operation and improvement of the Conference website. 

Use of Personal Information
The personal information collected on the Conference website will be used to operate the Conference website and to provide the service(s) or carry out the transaction(s) the Delegates has requested or authorised.

The Organiser may use the Delegate's personal information to provide the Delegate with important information about the Conference as well as about its products or services. The Organiser may also disclose personal information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on the Organiser or the Conference website; (b) protect and defend the rights or property of the Organiser and the family of the Organiser's websites; or (c) act in urgent circumstances to protect the personal safety of the Organiser's employees or agents, users of the Organisers products or services, or members of the public.

Personal information collected on the Conference website may be stored and processed in France, Germany or any other country in which the Organiser or its affiliates, subsidiaries or agents maintain facilities, and by using the Site, the Delegate consents to any such transfer of information outside of the Delegate's country.

Control of Personal Information
Except as otherwise described in this statement, personal information that the Delegate provides on the Conference website will not be shared outside of the Organiser and its controlled subsidiaries and affiliates without the Delegate's permission.  Please be aware that this privacy statement and any choices made on nagivating the Conference website will not necessarily apply to personal information that the Delegate may have provided to the Organiser in the context of other, separately operated, products or services of the Organiser.

Access to Personal Information
Customer information is collected by BeeQuest, a vendor of the Organiser. It is stored by and on behalf of BeeQuest, plus sent back to the Organiser. The Delegate can review and edit the personal information provided on the Conference website by sending an email to contact@beequest.com or by writing to :  BeeQuest SA, 5 allée Mirabeau

Security of Personal Information
The Organiser is committed to protecting the security of the Delegate's personal information. The Organiser uses a variety of security technologies and procedures to help protect the Delegate's personal information from unauthorized access, use, or disclosure. For example, the Organiser stores the personal information provided on computer servers with limited access that are located in controlled facilities.

Cookies
Cookies are used on the Conference website to ensure the integrity of the registration process and to personalize the Site. A cookie is a small text file that is placed on the Delegate's hard disc by a Web page server. Cookies cannot be used to run programs or deliver viruses to a computer. Cookies are uniquely assigned to the Delegate's computer and can only be read by a Web server in the domain that issued the cookie to that same computer.

If the Delegate chooses to decline cookies, the full experience of the interactive features of the Conference website cannot be guaranteed.

Changes to This Privacy Statement
 The Organiser may occasionally update this privacy statement. The Organiser encourages the Delegate to periodically review this privacy statement to stay informed about how the Organiser is helping to protect the personal information collected. The continued use of the service constitutes the Delegate's agreement to this privacy statement and any updates.

15/ LEGAL CLAUSE AND DISPUTE

Should a dispute arise, the only jurisdiction will be exclusively the Courts in Lyon (France). The French version of the present terms and conditions shall be considered valid and applicable.
